PROTECTION OF THE RIGHTS OF THE GERONTOLOGICAL CATEGORY OF THE POPULATION IN THE CONTEXT OF THE AGE DIGITAL DIVIDE IN THE INFORMATION ENVIRONMENT

Анотація

The modern dimension of legal relations between a person and the state requires subjects of power not to limit themselves to the formal recognition of a person as the highest social value, but to provide guarantees of his rights. The absence of effective legal instruments to ensure the interests of citizens nullifies the essence of the constitutional norms of the rule of law. The exponential development of the information environment has led to a natural transformation of the system of ensuring human rights, directing social processes into a digital format. The transition to digital legal relations has caused social inequality, as it has led to an age-related digital gap. In academic science, the digital gap is interpreted as an actual restriction of legal personality and discrimination against persons who are deprived of the opportunity to be equal participants in digital legal relations. The gerontological category of the population, which objectively finds itself outside the information environment due to the lack/absence of digital skills, turned out to be the most vulnerable to manifestations of digital exclusion.
