REVIEW OF THE REGULATORY FRAMEWORK FOR ENSURING THE ECONOMIC SECURITY OF AGRIBUSINESS ENTITIES

Анотація

Abstract. The article scientifically substantiates the theoretical, methodological, and applied principles for revising the regulatory framework to ensure the economic security of agrarian business entities in Ukraine amid the latest institutional and legal, military, digital, and European integration challenges. The relevance of the study is due to a fundamental change in the general model of economic and legal regulation in the state, caused by the loss of validity of the Economic Code of Ukraine from 28.08.2025 and the introduction of transitional regulation for certain organizational and legal forms of legal entities in accordance with Law No. 4196-IX. It is proven that under conditions of military destabilization, destruction of logistics, and climate risks, the category of economic security of the agribusiness goes beyond the classical protection of property or financial profitability, transforming into a multidimensional legal state of stability, continuity, and adaptability of the enterprise, which is a significant factor in preserving the national food system. The scientific novelty of the study lies in the development and theoretical conceptualization of the seven-level architecture of the updated regulatory framework, which consistently integrates the basic private law, resource-property, sectoral-agrarian, instrumental, control-compliance, security-stability, and integration levels. The author clarified the sectoral-agrarian core of the system based on the updated 2025 Law of Ukraine "On the Principles of State Agrarian Policy and State Policy of Rural Development" and Strategy-2030, and also revealed the logic of the transition from a fragmentary plurality of special acts to a coordinated framework model. The practical significance of the work is manifested in the detailing of the functioning of the digital-instrumental segment of the agro-industrial complex, in particular, the information and communication system "State Agrarian Register" (DAR) and the legislation on agricultural insurance with state support, which directly ensure the targeting of assistance, verification of beneficiaries, and maintenance of the creditworthiness of commodity producers. The necessity of compliance, cyber resilience, and protection of critical infrastructure within the framework of harmonization with the EU acquis for the full integration of domestic business into the global space is substantiated.
