Legal and management information: on the problem of their interrelation

Анотація

The article examines the interrelation between the concepts of «legal information» and «management information» within the framework of normative management processes. The author highlights the existing ambiguity and the absence of a unified definition of these concepts in scientific literature. Various approaches, including mathematical and cybernetic ones, are critically evaluated due to their excessive broadening of the term «management», which often leads to losing its essential characteristics. The author proposes defining normative information as the generic term for legal information, specifying that legal information is exclusively connected with social management processes involving normative managerial decisions. It is argued that not all normative information used in management processes can be regarded as legal, specifically, technical normative information falls outside this category. By classifying information according to its intended use — general information for mass consumption and specialized information for professionals — the author further refines the criteria for distinguishing legal information within management information. Real-life examples illustrate the practical application of the proposed distinctions, clearly demonstrating how legal information operates within judicial decision-making and procedural documents. A detailed case analysis of a court ruling on compensation for injury provides insight into how legal information emerges from normative decisions, not from procedural inputs such as the claim itself. Furthermore, the article explores the intricate relationship between normative-legal and normative-technical regulation, emphasizing the necessity of clearly differentiating these forms of regulation to establish a coherent legal system. A specific focus is placed on recent Ukrainian legislative acts, which demonstrate a lack of consistent approach in defining legal regulation versus technical standards. The paper argues that legislative texts sometimes mistakenly equate normative and legal regulation, which undermines the logical coherence of the legal system. The article concludes that a precise understanding of the relationship between legal and management information is crucial for developing a high-quality legal information system, essential for the effective integration of advanced information technologies in governance and legal regulation. The ability to clearly differentiate between types of normative information supports the appropriate use of such data in the preparation and implementation of legal decisions. Without this clarity, the implementation of digital legal infrastructure and smart governance frameworks may lack the necessary foundation for efficiency, transparency, and legal certainty.
