Legal instruments to ensure economic and social rights in Ukraine

Анотація

The oligarchic economic system formed in Ukraine does the same damage to individual freedom and other liberal values as uncontrolled political power. The oligarchy allows neither to form a socially oriented market structure of the economy nor to ensure the economic and social rights of citizens. The need to change the priorities of economic and social policy of the state has been substantiated and legal instruments have been proposed to achieve the standards of sociality in the relations between society and the state, which correspond to constitutional values, in particular the general legal principle of justice. It has been proposed to limit the economic power of oligarchs by introducing economic laws that affirm the principles of social justice in the distribution of the results of collective labor. The result of economic activity is newly created added value. The paper substantiates the components of the value-added and proposes a method of its monetary valuation by the market method, based on the balance of demand and supply. The components of the value-added determine the tax base of basic taxes and fees: VAT, PIT, SSC, income tax, and military duty. An effective method of controlling the compliance of the fair market value of goods/services and the amount of taxes and fees paid has been introduced, i.e., the fair market value is determined by the amount of taxes paid, which provides automatic control of the pricing mechanism.
