CONSTITUTIONAL AND LEGAL SECURITY OF DIGITAL RIGHTS OF CITIZENS: MODERN APPROACHES AND THE NEED TO UPDATE CONSTITUTIONAL REGULATION

The digitization of public authorities, the development of e-government and the active use of information and communication technologies are transforming the content of constitutional human rights. Modern forms of exercising the right to privacy, freedom of speech, access to information and participation in public administration are increasingly carried out in the digital environment. This necessitates the formation of a comprehensive constitutional and legal mechanism for ensuring the digital rights of citizens. Digital rights, which belong to the fourth generation of human rights, include classical rights adapted to the digital space and the latest legal constructs, in particular the right to be forgotten, the right to anonymity and digital identity. In the context of rapid digitalization and the introduction of electronic services of the state, key problems arise: fragmentation of legislation, the lack of a single definition of digital rights, the risks of excessive state control and the need for constitutional modernization. This becomes especially relevant in conditions of martial law, when the digital space simultaneously serves as a tool for protection, communication and management, but is a potential area of violation of rights and freedoms. The study of digital rights has not only theoretical, but also practical significance for the formation of modern legal policy, increasing the level of digital security and citizens' trust in electronic services. Improving legal regulation should be carried out on the basis of comprehensiveness and harmonization with European standards, include legislative, institutional, technical and educational measures, which will ensure the effective implementation and protection of digital rights in the digital environment.
