Unfair competition in view of threats to economic security in the conditions of digital transformation
Анотація
The article examines threats to economic security and counteraction against unfair competition in the conditions of the intellectual property economy’s digital transformation, taking into account the adoption of digital technologies and the use of digital platforms, which require new approaches to the perception of digital legal reality. Using the logical and theoretical generalization method, unfair competition is considered both in the conditions of the real intellectual property economy, where relevant legislative acts provide for civil, economic, criminal, and administrative liability, and of the real virtual digital economy of intellectual property, taking into account practice in the Internet network and problems of legal regulation in the virtual digital environment. The practice of unfair competition is considered as a problem statement that realizes the illusion of direct entry and presence in real time with the help of complex multimedia operating environments, where new forms of unfair competition are born, which requires adaptation of both legislation and protection of the new countermeasure system in the digital market of Ukraine and its harmonization with the legislation of the EU countries.
