Protection of intellectual property rights and commercialization of research and development results

Анотація

The current state of global economic development is characterized by the spread of innovation and the development of global and national systems for the protection and enforcement of intellectual property rights. The essence of the concept of "intellectual property rights protection" is defined by a comprehensive, internationally recognized regulatory mechanism for: the creation and recognition of rights to intellectual property objects and the prevention and elimination of violations of intellectual property rights, including through legal proceedings. In addition to the protection of intellectual property rights, the commercialization of research and development results is extremely important for the functioning of the intellectual property system. The purpose of the study is to summarize trends in the patenting of intellectual property rights over the years of independence, identify the main problems in forming a reliable intellectual property protection system, and create conditions for the commercialization of research and development results and technology transfer. It is recognized that intellectual property plays a decisive role in protecting technical or any other innovations. Currently, on the one hand, there is a process of strengthening the protection of personal non-property rights of creators of intellectual values, and on the other hand, there is a commercialization of property (economic) rights. The modern economy is increasingly focused on intangible assets protected by intellectual property rights, and rational IP management has become an integral part of any successful business strategy. Unfortunately, however, Ukraine has not yet managed to establish a reliable system for the protection of intellectual property. And in Ukraine, intellectual property is not yet considered one of the key factors in the country's economic development. The number of applications for industrial property rights has been steadily declining in terms of patenting inventions, utility models, and registering trademarks for goods and services. It is also necessary to note the extremely low level of investment by legal entities in research and development and intangible assets, and insignificant participation in technology transfer. It has been shown that startups are a new way of commercializing innovations or innovative technologies, which is more flexible and progressive compared to the traditional use of intellectual property. Despite the unstable economic situation, prolonged crisis, and other factors unfavorable for business, Ukrainians are developing successful startups. At the end of 2023, there were 1,500 active startups in Ukraine. The significance of Ukrainian startups is confirmed by their value. From 2020 to 2022, their value increased 3.3 times and reached €23.3 billion.
