Regulatory and legal framework of the investment component of Ukraine’s industrial policy in the Industry 4.0/5.0 paradigm

Анотація

The article examines the investment component of Ukraine’s state industrial policy from the perspective of its regulatory and legal support under the transition to the industrial paradigms of Industry 4.0 and 5.0. The system of current legal acts defining the instruments for attracting and stimulating investment in industry is analysed, and their compliance with the principles of digital transformation, innovative development, and environmental modernisation is assessed. It is established that the existing regulatory framework forms an extensive system of investment support instruments, including general investment regimes, special investment projects, industrial parks, localisation mechanisms, credit and financial instruments, and public-private partnerships. At the same time, most of these instruments are aimed at general capital attraction and support of entrepreneurial activity without clearly defined technological, innovation, and environmental priorities. It is shown that the institutional configuration of investment policy is characterised by fragmentation, the absence of technological selectivity, and insufficient coordination with industrial and innovation policies. The study substantiates the need to transform the investment component of state industrial policy towards supporting digital, innovative, and green investments, integrating the principles of Industry 4.0/5.0 into the core regulatory acts, and forming a coherent system of instruments for the technological modernisation of industry.
