HISTORICAL ASPECTS OF THE TREATMENT OF PRISONERS OF WAR
Анотація
The article examines the historical aspects of the treatment of prisoners of war. The term «prisoner of war» means any person captured or interned by a belligerent state during war. However, the author notes that with a theoretical approach, this concept can be applied both to members of regularly organized armed forces, and to partisans and civilians who openly fight the enemy, or non-combatants associated with military forces. In addition, the article reveals the evolution of the attitude towards prisoners of war. In particular, the peculiarities of the treatment of captives in ancient civilizations, the Roman Empire and the Middle Ages were considered; changes that took place in the treatment of prisoners from the Renaissance to the First World War; the influence of the Second World War and other armed conflicts of the 20th century on the fate of prisoners of war. Conclusions were made regarding the influence of various factors on the treatment of prisoners, the effectiveness of international norms regulating the treatment of prisoners of war was analyzed, and the prospects for the further development of humanitarian law in this area were determined. Attention is focused on the treatment of prisoners of war during martial law or the conduct of hostilities, the observance of their rights and the fulfillment of their duties. Threats regarding possible violations of the rights of prisoners of war and the importance of observing the norms of international law regarding the treatment of prisoners of war are determined. The study of historical experience allows us to draw conclusions about the importance of observing the humanitarian principles of warfare. In addition, the article reveals the practical significance of studying historical aspects of the treatment of prisoners of war, in particular: understanding the evolution of norms and rules that regulate this sphere; analysis of factors affecting the treatment of prisoners of war; classification of the main violations of the norms and rules of treatment of prisoners of war that took place in history; development of effective mechanisms for protecting the rights of prisoners of war.
