DIGITALIZATION AS A FACTOR IN THE TRANSFORMATION OF ADMINISTRATIVE AND LEGAL FRAMEWORK FOR HUMAN RIGHTS PROTECTION

Анотація

The purpose of the article is to reveal digitalization as a factor in the transformation of the administrative and legal framework for human rights protection, as well as to clarify its content, features, and place within the system of administrative and legal regulation.Results.The article determines that digitalization is a complex, systemic, and dynamic process of introducing digital technologies, electronic services, information and communication systems, automation tools, electronic identification, data processing, and online interaction into various spheres of social, economic, managerial, and legal life.As a result, the ways of creating, transmitting, using, and protecting information are transformed, and traditional models of interaction between individuals, society, business, and the state are reshaped.At the same time, digitalization should not be reduced merely to the technical conversion of information into electronic form, since its content is much broader and consists in the formation of a new digital environment in which technologies become a tool for improving the efficiency of public administration, the accessibility of administrative and other public services, the transparency of governance processes, the development of e-democracy, the realization of citizens' digital rights, and the modernization of legal mechanisms for human rights protection.In this understanding, digitalization is not a supplementary technological phenomenon but one of the key factors transforming the state and society, influencing the quality of human life, the level of realization of rights, the nature of public administration, and the state's ability to adapt administrative and legal instruments to new social, legal, and technological challenges.Conclusions.The article emphasizes that digitalization, as a multidimensional sociolegal phenomenon, is not limited to the technical implementation of digital tools but encompasses a profound transformation of the ways social relations are organized, public administration functions, services are delivered, information is exchanged, and human rights are realized.Its essence is revealed through the combination of two interrelated approaches: (i) a technological approach, focusing on the use of digital tools, platforms, electronic services, and information and communication systems; and (ii) a transformational approach, within which digital technologies act as a driver of change in the development model of the state, society, and legal regulation itself.Therefore, the expansion of e-government, e-commerce, digital banking services, online education, telemedicine, the Internet of Things, and artificial intelligence indicates the formation of a new digital environment in which administrative and legal mechanisms must not only ensure the effectiveness of innovations but also guarantee security, accessibility, transparency, personal data protection, and prevent the narrowing of human rights under the influence of technological change.
