GENERIC CONCEPT OF HARM, SPECIFIC IN RELATION TO IT THE CONCEPT OF THE INSTITUTION OF OBLIGATIONS DUE TO HARM AND RELATED CONCEPTS OF CIVIL LAW
Анотація
The article examines the concepts of harm, species and related concepts in relation to it. It is proved that in Chapter 59 of the Civil code, the term «harm» refers to both the generic concept that covers property and moral harm, and the specific concept of property harm in relation to it. Therefore, in paragraph 1 of article 1064 of the civil code, it should be clarified that damage in paragraphs 1-3 of Chapter 59 of the Civil code is understood as property damage. It is also proposed to unify the terminology related to compensation for property and non-pecuniary damage.
