The challenges for the European Union migration law due to the full-scale war in Ukraine

The article analyses the challenges faced by European Union migration law in the face of the full-scale war in Ukraine. Europe has not faced such serious geopolitical and migration and displacement issues since the Second World War. The armed conflict in Ukraine, launched by Russia on 24 February 2022, has forced millions of Ukrainians to flee the country, mainly to EU territories. The article discusses key aspects of the EU’s migration policy, which seeks to create a ‘comprehensive migration policy’ in line with the admission of third-country nationals, while protecting the common border. Particular attention is paid to the 2001 Temporary Protection Directive, activated after the start of the war, which provides Ukrainians with legal status and protection in the EU. The article also highlights the need for reforms in EU migration policy to meet current and future migration challenges, including an ageing population and labour market shortages, proposing new approaches to legal migration and integration.
