Regulación jurídica de liquidación de cuentas por transferencia bancaria en Ucrania

Анотація

The article studies and analyzes the content of legal regulation of cashless payments in Ukraine. Using general and special methods of scientific cognition, the authors have studied scientific sources, international law, laws of Ukraine and current bylaws and regulations governing non-cash payments. It has been established that settlement obligations arise from the transfer or relocation of funds from the debtor through a bank or other credit institutions to the creditor, in order to fulfill a monetary obligation. Using the methods of analysis and comparative jurisprudence, the authors reveal the content of certain concepts and legal definitions (settlement, letter of credit, settlement check, electronic means of payment, bill of exchange, payment claim, contractual write-off). This also allowed to analyze the norms of current national and international legislation on the content and mechanisms of legal regulation of certain types of cashless payments. The researchers found that the requirements of the laws of Ukraine establish a priority for non-cash payments, and the main types of non-cash payments that are legally defined in Ukrainian law are: letters of credit, settlement checks, electronic means of payment, bills of exchange. By applying the sociological research method, the authors studied the indices of the level of introduction of cryptocurrency and electronic money in different countries of the world and the impact of their specific features on the content of legal regulation.
