Correlation between the Concepts of Personal Data and Other Types of Data in the Light of Ensuring Human Rights

Анотація

The inviolability of private life as a component of human rights is reflected in the autonomy guaranteed to all individuals, both in international law and in national constitutions, with informational autonomy being a form of this autonomy.At the core of informational autonomy lies the institution of personal data protection, which is a system of legal norms designed to regulate relations concerning the collection, storage, use, and deletion of information by which a person can be identified.Due to the rapid growth of the role of data in the comprehensive digitalisation of various spheres of public life, the issue of improving the legal regulation of the institution of personal data protection (i.e., defining the legislative framework for the processing of personal data), has become particularly relevant.In this article, the author attempted to establish the relationships among the types of data defined by Ukrainian national legislation that fall under the category of personal data, highlighting confidential information, personal data with special processing requirements, biometric data, and facial templates used for facial recognition.The study raised the question of why personal data needed to be protected, drawing on three interrelated approaches grounded in relevant rights: privacy, freedom of personal development (information self-determination), and personal data protection (Article 8 of the EU Charter of Fundamental Rights).
