The concept and content of the principle of state support for local self-government in Ukraine

Анотація

The article is devoted to the study of the principle of state support for local self-government in Ukraine. Taking into account the achievements of constitutional and municipal law, the author defines the concept and content of the principle of state support for local self-government, as well as its place in the system of basic principles of local self-government, identifies the factors that determine the need to enshrine this principle in the legislation of Ukraine and the formation of state policy aimed at its practical implementation. In particular, the article proposes that the concept of «principle of state support for local self-government» should be understood as a conscious objective regularity of local self-government implementation enshrined in the Constitution and laws of Ukraine in the form of the starting points (principles) which oblige the State to promote the establishment and development of local self-government as one of the foundations of the democratic system; the author establishes that the content of this principle is to perform the constituent function and to guarantee local self-government through its regulatory, legal, material and financial, organizational, personnel, information, scientific and methodological support; the author proves that the objective, natural nature of this principle is due to the fact that the development of local self-government is impossible without State support; the author determines that this principle is a constitutional principle which should be implemented within the powers defined by the Constitution and in accordance with the
