TRENDS IN DIGITAL DEVELOPMENT OF CONSTITUTIONAL LAW AND PROBLEMS OF ADAPTATION TO MODERN CHALLENGES
Анотація
The purpose of the study is to identify trends in the digital development of constitutional law, as well as to substantiate the directions of adapting constitutional and legal guarantees to modern challenges in the internal and external digital environment.The object of the study is social relations that arise in the process of implementing, ensuring and protecting constitutional rights and freedoms under the conditions of the spread of decisions based on applied digital technologies.The study reveals trends in the digital development of constitutional law and outlines the problems of adapting constitutional and legal mechanisms to challenges that are exacerbated by the transfer of a significant part of social processes to digital channels.It is shown that the transformation of methods of communication, management and provision of public services changes the practical content of constitutional rights, in particular the right to privacy, protection of personal data, freedom of expression, access to information, equality and non-discrimination, as well as the right to a fair procedure and effective appeal.It is determined that data and algorithmic approaches Vda a perspektivy 2(57) 2026
