FORMULATION AND IMPLEMENTATION OF THE STATE POLICY ON PROVIDING HOUSING FOR INTERNALLY DISPLACED PERSONS (ON THE EXAMPLE OF IVAN-FRANKIV REGION)

Анотація

The article highlights the problems of the formation and implementation of state policy regarding the provision of housing for internally displaced persons (IDPs), especially during the years of the full-scale Russian-Ukrainian war, starting from February 20, 2014; the legislative and regulatory support for the formation of housing funds for the temporary residence of IDPs and the procedure for providing temporary use of residential premises from the housing funds for the temporary residence of IDPs were analyzed; it has been proven that in Ukraine, the powers of state authorities and local self-government bodies regarding the provision of housing for IDPs, the procedures and conditions for the exercise of such a right are properly defined by law; it is shown that currently in the national regulatory and legal field there are several forms and tools for ensuring the right to housing of IDPs, taking into account their needs (such as the provision of temporary or permanent housing), their situation (social housing taking into account the order of its receipt), opportunities, etc.; at the same time, it is noted that public administration bodies currently do not fully meet the housing needs of IDPs, sometimes delay the allocation of land plots for housing for IDPs, unnecessarily delay its construction and commissioning; it is emphasized that in some places there is opposition from the local population against the construction of housing for compact living of IDPs, which, in their opinion, will contribute to the extrapolation of the «Russian peace» to the western territories of Ukraine; it was concluded that the Ukrainian state should do everything possible to provide IDPs with housing as soon as possible in order to promote the inclusion of IDPs in territorial communities (temporarily or permanently) and, if necessary, their employment, primarily at relocated enterprises, providing places for their children in schools and kindergartens, social protection of the elderly, thereby facilitating their participation caused by the Russian-Ukrainian war.
