REGULATORY SOFTWARE OF RESOURCE COMPONENT INSTITUTIONAL CAPACITY OF REPRESENTATIVE BODIES OF LOCAL SELF-GOVERNMENT

Анотація

The normative legal regulation of the component of the institutional capacity of representative bodies of local self - government is investigated in the article. Based on the legal framework, it is proved that the provision is the material and financial basis, which determines the ability of the representative body of local self-government to perform its functions and exercise the powers conferred by law. It is revealed that the issue of the component of the institutional capacity of representative bodies of local self-government is relevant among scientists, in scientific research there is a different classification of resources. Also from the standpoint of science, it is important to define the concept of resource provision, because it reflects the procedures of representative local governments, to meet unlimited needs, and resources to meet them are limited, it is representative local governments should try to influence the level of production and accumulation of resources . It is established that the representative bodies of local self-government should develop a resource platform of the territory which will include inventoried communal property: movable and immovable property, local budget revenues, other funds, land, natural resources, enterprises, institutions and organizations, including banks, insurance companies, as well as pension funds, share in the property of enterprises, housing, non-residential premises, local energy systems, public transport, communication and information systems, cultural, educational, sports, health, science, social services, property transferred to communal ownership by other subjects of ownership and any other property, movable and immovable objects, which by right of ownership belong to territorial communities, as well as funds received from the alienation of objects of communal property rights. The laws “On local self-government in Ukraine”, “On the state budget for 2021”, “On cooperation of territorial communities”, “On amendments to the Budget Code of Ukraine to bring the provisions of budget legislation in line with the completion of administrative-territorial reforms ”, which regulate the component of institutional capacity and are guides in the work of representative bodies of local self-government. It is concluded that it is impossible to solve urgent problems at the expense of internal financial resources, therefore it is proposed to attract investments and other resources from outside.
