LEGAL FRAMEWORK AND PROBLEMS IN ACCOUNTING AND SEARCHING FOR MISSING PERSONS DURING ARMED CONFLICTS

Анотація

The article is about the legal framework that regulates accounting and searching for missing persons (including military men during their military service) and ensuring coordination of activities of state bodies authorized to register and / or search missing persons, including the search in the area of the anti-terrorist operation on the territory of Donetsk and Lugansk regions, area of implementation of ensuring national security and defense measures, reduction of the armed aggression of the Russian Federation and accounting and searching for missing persons during armed conflicts, military actions, public disorder within the state or emergencies of a natural or man-made nature or other events that could cause massive loss of life. The legal status and legal regulation of relations related to the establishment and registration, search and social protection of missing persons and their relatives is determined. As a result of the study it was established that the legal framework on accounting and searching for missing persons contains the large volume of international and national normative acts of different legal force that must be improved and implemented in a proper way. The mechanism of accounting and searching for missing persons (including military men during their military service) will work depending on the interpretation of certain provisions of the adopted law already in practice, the adoption and implementation of subordinate acts; under the conditions of highly professional staffing, resolving the issue of the Commission’s work and the functioning of the relevant Register in the system of military justice bodies of Ukraine.
